You Xian acts for local and international clients in shipping, insurance and reinsurance, construction, oil & gas and securities matters. - Acting for a charterer in a London-seated LMAA arbitration, resolving procedural issues under the Civil Evidence Act 1995 and IBA Rules and interpretation of off-hire clause in a BIMCO charterparty dispute.
- Acted for a sovereign wealth fund in multi-jurisdictional litigation before the Malaysian courts, obtained Mareva injunction and addressed claims of breach of directors’ duties, conspiracy, and dishonest assistance against former senior executives.
- Obtained a worldwide Mareva injunction from the Malaysian High Court in aid of SIAC arbitration proceedings, freezing assets in a high-value dispute arising from a sanctioned crude oil sale and purchase agreement.
- Performed ship arrest in Malaysian admiralty proceedings, securing vessel as security for foreign court proceedings.
- Represented a local oil & gas company in concurrent Malaysian High Court litigation and arbitration proceedings concerning breach of a ship management agreement and voyage charterparty regarding lease disputes of a floating storage unit vessel.
- Represented a leading Malaysian logistics company in an AIAC international arbitration, involving a contractual dispute concerning alleged port delays and demurrage claims.
- Successfully obtained summary determination in favour of the respondent in an AIAC arbitration, defeating a claimant’s partnership dispute claims at a preliminary stage.
- Represented a Korean venture capital firm in an UNCITRAL arbitration administered by HKIAC, securing an USD 87.8 million award in a misrepresentation claim while overcoming complex evidentiary challenges concerning document authenticity under the IBA Rules on Evidence.
